Good question! I suppose there is a difference between using clips in a new episode and using those self-same clips in a documentary setting. Clearly, in the Season 8 bonus material, the authors were attempting to document the development of Charmed and what it led to, how the acting parts were cast, etc. Using clips to illustrate this is fair-use, just as if I had written a term paper and quoted from some physicist in order to make a point about the energy-mass equivalence. Under existing copyright law, that constitutes a fair use.

Now, if I took the quote - unattributed, say - and built an entire argument around some point and claimed it was mine, I would have violated fair usage and engaged in some form of plagiarism. In Cat House, for example, the clips from the past were not used to document the genesis or evolution of Charmed, but as integral parts in the creation of a new story: Cat House.

Actors whose images appeared in these extensions of the original clips without their permission clearly would have a basis for suing based on non-fair usage of the image of likeness of the character. As it was clear that Shannen Doherty had no intention of ever giving permission for her likeness or image in any further production of Charmed, the writers/producers had to recast the actors in the motorcycle scene. (That is not Shannen's back. And, they had to edit out any clips that might have featured Shannen indirectly.)

I have to disagree with that. It's Shannen's face that cannot be shown. I've come to this conclusion for several reasons but to address the motorcycle scene first..

They are identical. Down to the design on the back of TJ's helmet, the position of the cake figurines, the decorations, her heal on the pink drape, the belt. With how inconsistant Charmed had gotten by season 5, I doubt a recast would have focused that closely on details for so quick of shots. That's Shannen.

Also, I know this one is small, but in Phoebe's "remember the losses" vision in season 7 Charmegeddon..it shows Prue holding Piper's hand in the hospital when she's about to die in All Hell Breaks Loose.

Thirdly..in the promo for the very final episode of Charmed, they flash through clips VERY quickly. Most of it was season 7..but season 1 was involved. I downloaded it and paused it for no particular reason, and I ended up pausing it on the image of Prue holding the mirror in front of her face from I've Got You Under My Skin. Though it was VERY quick..still..they specifically picked a clip that did not show her face.

It was just the promo for Forever Charmed. I downloaded it around the time it came out a year and a half ago so I have no idea and I no longer have it.

Thanks, OP3, for the clarification. When I originally saw Cat House, I always assumed it was Prue's back. However, someone else in perhaps the Season 8 thread emphatically stated that no it was another actress that had to be recast even to show her back. As I am not privy to the details, I accepted this as such and reported it further without referencing the source. Thank you, then, for the clarification.

One question that arises, however, pertains to Dorian Gregory. In the Just Harried scene, you can see just about every part of his upper torso except for his face. I can't recall whether he was credited, as was Julian and the other "guests" whose images were featured during Cat House.

It makes sense that it is the facial image that matters since that is the most recognizable and valuable part of an actor/actress. (Apologies to Pam Anderson fans. But, then, is she an actress? Barbed Wire notwithstanding)

I asked an actor today at lunch on this very issue. He (Tommy Hicks), the station commander in All Hell Breaks Loose and A Paige from the Past, whether Shannen's body parts - apart from her face - could be used without credit. He was of the impression that they could not be. Ergo: perhaps they did use a stunt double. Can anyone provide exact information on this issue?

The only thing I can think of regarding the motorcycle issue is that possibly it wasn't Shannen in that scene to begin with. That it was the back of a stunt double in order to ride the motorcycle out as I know that many times when you don't see the actors faces, it's usually not that.

However, that doesn't explain the 2 other uses. It *could* be another actor holding Piper's hand in the flashback, but with the way that scene was being shot, I honestly doubt it. But there's absolutely no mistaking the fact that it's Shannen holding the mirror in fron of her face in I've Got You Under My Skin in the quick clip promo for the finale.

I like your idea with respect to the Harley. Since I've not seen this quick promo click for Forever Charmed, I'll beg off. By the way, what was this exactly? Was it a WB promo run at the end of Kill Billie Volume 2 or an episode even prior to this?

I think you are right! I was able to pause it (after rewinding and searching many times-it does go by REALLY fast) I think it MUST be Shannen!
